An Analysis Of Collective Land Expropriation System

The stock of the city state-owned land has been increasingly inadequate with the acceleration of China’s city development. The country through administrative means collection of rural collective land for city construction which is normal.Because of the compensation and resettlement forms, procedures and other reasons, many incidents of group events have appeared in recent years. The author tries to analyze our country countryside collective land collection system in from the several angles. So as to form several policy suggestionsThe first part of the thesis focuses on the analysis of China’s current land expropriation system. Through combing the relevant laws, regulations and policy documents, it masters the basic legal context of Chinese land expropriation, and puts forward the judgment of public interest. Of course, the standard of compensation for expropriation are questionable. The second part of the thesis focuses on researching the cause of the problem. The third part focuses on quoting foreign land expropriation system for comparison and reference. The fourth part is to put forward the author’s suggestions. It points out that our country should publish the introduction of a national level "collective land requisition compensation ordinance" as promulgated "state-owned land on the housing levy and Compensation Ordinance". In order to allocate standard, procedure and compensation of expropriation. And put forward as a supporting, China should build a long-term mechanism of increasing income of farmers, so as to establish a complete and fair land expropriation system.
