Recently,some words like"public interesf" and "public interest litigation"came into our eyes frequently,not only because our public awareness was increased,but also the economy was developed quickly and modern life go faster,result in the destruction of public interest,for example, environment was destroyed and the rights of consumers was ignored and the waste of resources.To reduce such events happen and retrieve the loss of the public interest,the public interest litigation system must be established and consummated.Our country put public interest litigation system into judicial procedure through amend the Civil Procedure Law in2012.It supplies the source of law for resolving the public disputes.But the public interest litigation system was to principled to be applied in practice,it lacks the subject of litigation and litigation mode and legal costs and rules of evidence.This messy will draw lessons from foreign perfect experience of public interest litigation system,study on public interest litigation through the type of analysis method,put forward a perfect suggestion for our country’s public interest litigation.The first part of this messy make an overview of the public interest litigation.introduce the development of it and then analysis of the current situation, the development of our country’s problems.The second part introduces the method of type analysis, through the classification of the public interest,the civil public interest litigation system is divided into:(1)the pure civil public interest litigation,(2)composite civil public interest litigation,(3)the private of public interest litigation.The third part puts forward some suggestions on the civil public interest litigation system in our country, the main prosecution, litigation request, the lawsuit cost and program security system.
