Recently, much attention has been paid on grassroots autonomy system. And itselement—rural environment autonomy, which emerges as the times requires, is the “a goldenkey” to the problem. Analyzing and carrying out rural environment autonomy will not only helpto get out of dilemma in rural environment renovation works, but arouse farmers’ lawconsciousness to lay the foundation of China’s rule by law. This paper refers to five parts.The first part is to define rural environment autonomy and analyze its construction. Ruralenvironment autonomy indicates that our state admits farmers can govern rural environment bythemselves. Based on the elemental theory of power constitution, this part introduces ruralenvironment autonomy and its constructional analysis from five elements including “subject”,“rights”,“proposition”,“freedom” and “procedure”.The second part is to introduce rational source of rural environment autonomy. As one ofconstitutional rights of citizens, it is based on constitutional rights. As vivid practice ofgrassroots self-government, it actually relies on law of rural grassroots organization. Ascontinuation of “soft law”, it is based on rural lineage relation.The third part is to analyze rural environment problems. Those problems are following:Pollution in agricultural production and life is increasingly worse. The layout of townshipenterprises is unreasonable. Blind investment promotion exacerbates environmental degradation.Special legislation in the field of rural environment exists blind spot as well as judicial protection.There are many reasons why those problems occurs such as the mixture of problems left over byhistory and practical difficulties, non-standard production method and life style of farmers, the“short, adaptable and fast” thought in agricultural modernization and rough-and-ready legalconstructure.The fourth part is to discuss how to syncretize rural environment autonomy andenvironmental executive power of grassroots government. This part mainly talk about fiveaspects. They respectively are that authority boundary is delimited, that the feasibility of ruralenvironment autonomy is discussed, that rural environment autonomy constrain farmers’environmental life, that rural environment autonomy is the road leading to grassroots democracyand so on.The fifth part is to take Shuyang County, Jiangsu Province as an example to investigaterural environment autonomy. Shuyang County is prior to try and carry Out this policy in the field of rural environment and push forward rural environmentautonomy. Village committee working as the autonomic main body, Shuyang County allocaterights and responsibilities and define the standard of government down to the ground. At the end,the shortages of and suggestion for the pilot work of Shuyang County are analyzed. At the sametime, its typicality and generalization are discussed.
