Research On The Institution Of Hong Kong Independent Commission Against Corruption And Its Enlightenment To The Construction Of Anti - Corruption In Mainland China

There is a world-wide existence of the phenomenon of corruption, while the reason lies in the lack of effective regulations and the power without effective restriction. Especially in some countries whose social and economic development is in a transition stage and some developing countries, the corruption phenomenon is more serious. Corruption that makes the market face more unknown risks during economic activities, further increases in transaction costs, violated the concept of social equity and justice, which have very bad impact in various fields, such as politics, economy, culture, society etc..Therefore, many countries and regions around the world have attached great importance to anti-corruption work.In1970s Corruption in Hong Kong was rampant,which had severely restricted the effective distribution of social resources, hindered the sustainable development of economy. Hong Kong authorities awared of the seriousness of the problem, created the ICAC system, specifically responsible for anti-corruption work. After a long-term unremitting efforts, the work of the cultivation of clean government of the Hong Kong Special Administrative Region had made great achievements, political clarity laid a good foundation for the economic take-off in Hong Kong. System has the characteristics of fundamental, stability, long-term and overall situation, and the Hong Kong ICAC system plays a key role in the struggle against corruption, whose effect is obvious to all.At present, our country’s government is vigorously promoting the anti-corruption construction, but the situation is still grim. Hong Kong and the mainland of the similar social and cultural background, we can have a foothold in the Chinese mainland anti-corruption construction problems in the process, to learn successful practice experience from Hong Kong commission against corruption system, to reform and perfect the anti-corruption system, to safeguard social fairness and justice, and to promote the harmonious development of society.This article adopts the literature methodology, system analysis and system analysis methods, makes a deep analysis of Hong Kong ICAC system, bases on the actual problems which appear during the process of current mainland anti-corruption construction, puts forward some enlightenments which learn from the system of the Hong Kong ICAC for the construction of anti-corruption in our mainland. The full text is divided into five parts:the first part, overviewing the corruption and other related concepts and theories, lay a theoretical foundation for further analysis of ICAC system. The second part, the establishment of the Hong Kong ICAC’s background and development course is embodied. The third part, the key analysis of the Hong Kong ICAC system structure, function and supervision system. The fourth part, With the mainland by Hong Kong ICAC system comparative analysis of the construction of the anti-corruption, find out the place of the Hong Kong advanced and deficiency existing in the mainland. The fifth part, on the basis of above analysis, put forward the system of Hong Kong ICAC for specific revelations of the mainland anti-corruption construction.
