With the progress of time, upgrade technology, and constantly improve people’s spiritual needs, intellectual property, this new property quietly comes into the horizon. Intellectual property rights in patents, trademarks, copyrights headed regulate the inventor’s creation, and give recognition and economic interests. Lincoln’s "fire of genius" sums up the role of a good intellectual property. Intellectual property is a way to continue to encourage people to stimulate the creation of re-creation, and through the exchange of interests, to promote the creation of human wisdom achievements show in front of people.But benefit where there are disputes, with the value of intellectual property continues to be accepted and increases, intellectual property rights in divorce proceedings on the ownership issue is particularly prominent. Since our current intellectual property rights in divorce proceedings legislation is not perfect division, and the theory has yet to be discussed, which makes the intellectual property, how to split equity become the focus of research in divorce proceedings.This paper is divided into four chapters to study this issue.The first chapter filed for the particularity of the intellectual property division in a divorce.
