Research On Criminal Responsibility Of Water Traffic Accident

Compared with traffic accidents on road, The legal orders damaged or the legal interests undermined in waterborne traffic accidents may be more complex and diverse. Besides, the economical damage caused in a specific waterborne traffic accident seems to be greater normally. However, In the judicial practice there was only a few criminal cases related to waterborne traffic accidents. The controversy in respect of legal basis and judgement counts does exsist among these cases which result disruption of the judicial fairness and authority. Given all of these, this paper tries to advice on measures to solve these problems by analyzing the causes, and aims to balance the criminal liabilities as regard to waterborne traffic accidents in both theories and practices.In addition to the introduction, this paper consists of six chapters.Chapter Ⅰ introduces definitions、classifications、causes, consequences and characteristics of waterborne traffic accidents.Chapter Ⅱ goes through the applicable legal rules and accountability of criminal liabilities in waterborne traffic accident.Chapter Ⅲ analyzes our current judicial practices of holding accountable of criminal liabilities in waterborne traffic accidents, and summarizes the most urgent problems both in theory study and judicial practices.Chapter Ⅳ tries to find the main factors both in theory study and judicial practices which result the problems in holding of accountable criminal liabilities in waterborne traffic accidents.Chapter Ⅴ focuses on the necessity to strengthen the holding of accountable criminal liabilities in waterborne traffic accidents considering the following facts such as the current status&development trend of the water transport industry、insufficiency in current legal regulations and the changing of national environment criminology policies.Chapter VI is about suggestions and measures.
