A Study On The Actionability Of Quasi - Administrative Action

Abstract:Quasi administrative behavior triggered a lot of controversy in the circles of theory and practice. This paper firstly combs administrative behavior (the core of the theory of administrative law), then makes the theoretical orientation of quasi administrative behavior that quasi-administrative acts belong to types of conduct under the broad concept of administrative acts. For the suability of the quasi administrative behavior in practice, this paper establishes five standards of suability of the quasi administrative behavior based on features of the administrative behavior as the starting point. And this paper makes theoretical and suable analysis of the typical quasi administrative behavior such as notarial act, the report about the responsibility of traffic accident and the medical accident identification conclusion, aiming to accomplish achievements in theory about the practical operation of suability of the quasi administrative behavior.
