Analysis On Authorized Legislation Of Special Economic Zones

In the past more than thirty years, with the constitution of Chinese special economic zones, it has made many useful explorations and try in the establishment of export-oriented development of the market economy legal system. Special Economic Zone authorized legislation system is a new type of authorized legislation which is generated by the reform and open policy. The new type authorized legislation play a positive role in promoting economic zone economy and legal construction, which is institutionalized by means of Legislation Law of the People’s Republic of China. However, according to the present legal system, especially in practice, Special Economic Zone of the authorized legislation has some problems, for example, the scope of authorization is indistinct, the legislative competence is not clear, authority intendance is not perfect and so on. To some extent, these problems restrict the active development of the special economic zone of authorized legislation.The text makes some consideration on how to improve the system of the special economic zones of authorized legislation upon the present system by means of the complete observation on it and taking the practical work into consideration, whose purpose is that the unique system can be operated well to serve the economic and social development of the special economic zones.The text is divided into four chapters.The first chapter overviews the authorized legislation and the special economic zones of authorized legislation.The second chapter states the competence and the intendance system of special economic zone authorized legislation, it also discusses its effect on the construction of special economic zone. The third chapter analyses the characteristics of special economic zones authorized legislation, especially comparing with the functional legislation of economic zones’so called " A City of Two Law "The fourth chapter ponders and probes the practical issues on how to use the special economic zones of authorized legislation and improve the legislative technology in combination with author’s working practice.
