The oil pollution of sea caused by ship collision is always the arguing point ofEnvironment Law and Maritime Law. This collision includes two kinds of differenttort relations such as ship collision tort relation and marine pollution of oil spill. Butthose different relations shall apply different criterion of liabilities, and regulateddifferent ways of liability-undertaking. Because of the lose of specific regulations andthe different understanding of those two tort relations as well as the different legalapplication in cases, the liability of this special kind of tort get lots of attention ofscholars.Starting at the ship collision, this article intends to reduce this question to oilspilling of single ship, from this model to discuss the liability of oil pollution causedby ship collision. This article beginning with the basic conception of oil pollution andship collision, introduced the classification,criterion of liability, damaging extent andexcuse of no responsibility. Then from the legal theory and judiciary practice,discussed the primary questions beginning form the different regulations. In the fourthpart of this article, the writer detailed analyzed those question and provided ownsuggestions to complete the liability regulations of oil pollution.The innovation of this article is it intending to limit the situation of oil spill tosingle ship, and considering those questions entirely and systematically.
