On The Introduction Of Temporary Arbitration System In China 's International Aviation

In recent years, China is prosperous at its air transportation industry, and therapid development of air transportation has brought about the drastic increase ofaviation disputes. At this very moment, that is, the establishment of the InternationalAviation Arbitration in Shanghai, ad hoc arbitration should be admitted into ourarbitration legal systerm.Three chapters compose this article. The first section is an overview of ad hocArbitration. This part not only mainly introduces the origin, development,characteristics, concept and basic theory of ad hoc arbitration; but also brieflydescribes the characteristics of aviation disputes, and the advantages of ad hocarbitration in solving the aviation disputes. The second section focuses on thelegislation and practice of aviation arbitration. This part not only introduces thelegislation of foreign countries, some important international conventions, two casesand the practice of International Civil Aviation Organization and International AirTransport Association, but also describes the enlightenment to our country. The thirdsection analyzes the necessity and feasibility on establishing international aviationarbitration in our country, provides five proposals for our country’s establishment ofinternational aviation arbitration.
