The International Tribunal for the law of the sea is about the settlement of maritimedisputes permanent judicial offices set up in the "United Nations Convention on thelaw of the sea" in the acceptance of the relevant provisions of the "United NationsConvention on the law of the sea" in the maritime disputes.1982"United NationsConvention on the law of the sea" does not require the court full court with the powerof the advisory jurisdiction, and the International Tribunal for the law of the sea in1997set the rules of the court "138th" in fact declared the court full court with theAdvisory jurisdiction. For the internal rules override the Convention gives theexternal power in the international practice, the judicial practice is hitherto unknown.Also because of this, many scholars have to "the rules of the court"138th provisionsfrom different angles, to prove its legitimacy, unfortunately, that there is still noconsensus.In view of this, this paper based on these arguments, the Advisory Jurisdiction ofthe International Tribunal for the law of the sea ", the Advisory Jurisdiction of therelevant laws and regulations, the current theoretical controversy, and otherinternational judicial institutions advisory jurisdiction of the contrast and21case, thelegitimacy of the jurisdiction of the court full court of consulting research. The authorhopes that based on both theory and practice, attempts to prove the legitimacy of theInternational Tribunal for the law of the advisory jurisdiction the court, to provide atheoretical basis for the judicial practice in our country in the future.
