Compulsory arbitration procedure is a unique compulsory dispute settlementmechanism in UNCLOS. Philippines submission of the dispute to the Internationalarbitration tribunal evades the limitations to applicability of the procedure,thereforeChina s rejection to the arbitration only means a preliminary objection to thejurisdiction of the tribunal but cannot cease the procedure. With regard to thedevelopment of the compulsory arbitration,China should insist its claims forsovereignty on the islands in the South China Sea and regions within the Nine-dashed line,and declare that the tribunal has no jurisdiction on the dispute,meanwhile by virtue of the UN and the ASEAN refrain the passive impact on China.Besides China should intensify the actual control of the disputed regions betweenChina and Philippines by building marine structures and setting up the ADIZ,tomaintain its inherent interests on the South China Sea....
