China 's Legislative Public Participation System

Public participation in legislation is the inevitable requirement of democratization. National legislation can be obedience and respect, to a great extent because of the country’s legislation is the embodiment of public opinion, in the process of legislation fully reflects the interests of most people. Both the view from the ancient Greek period of direct participation and modern representative system, democracy and justice are the important theoretical basis.our country is to carry out democratic decision by representatives of people’s Congress, reflect public opinion. But by the complex social relations and may appear to represent not capable of true expression of public opinion or because of a misunderstanding cause the error of the expression of public opinion of the situation. So the purpose of this paper is introduce the related problems of public participation in legislation to point to gradually build and perfect the current representative democracy, by expanding the scope of public participation and improve public participation of other more deficiencies to speed up the legislative process of democratization should road to rule of law in china.This paper mainly from the basic theoretical problems of public participation system in the legislation to do a simple introduction, respectively on the aspects of its concept and characteristics about, and in the next article from the necessity of public participation in legislation about, stressed the need to build a harmonious society through public participation in legislative activities, the development of democratic system, solution the legislative process in the public power separation constraints "principle contradictions and improve legislation scientifically, strengthen citizen’s main body consciousness, enhance the stability of the law etc. The next to summarize the development of the implementation of legislation on the system of public participation in our country, which leads to the key question about, namely the detail process of current legislation of our country public participation system specific problems.
