On February12,2013, North Korea tested its third nuclear device, which arose strongcondemnation around the world. Security Council of United Nations adopted the Resolution2094(2013)at its6932ndmeeting on7March2013, expressing its negative attitude and some sanctions against NorthKorea. But North Korea did not restrain itself. North Korea did not sign any bilateral treaties which couldpossibly govern its behavior. In only signed the NPT, but withdrew from it on April10,2003. Under thiskind of circumstances, we should look for international law in other aspects in order to stop North Koreafrom keeping on doing its nuclear tests.I divided my paper to five parts to analysis the related international problems about North Korea nucleartests. Firstly, I will introduce the precautionary principle, which is the best way to handle with thecircumstances with no enough evidence or actual damage results; secondly, I will talk about the nationalresponsibility North Korea should take by carrying on nuclear tests; thirdly, because of the quitting fromNPT, I am going to discuss some other possible international documents which might be applied to thisissue; then I will focus on the way how China could get the initiative to take measures against NorthKorean nuclear tests and I will reveal some blocks and put forward some recommendations for that;finally, I will discuss North Korea’s behavior of quitting the NPT.
