A Study On The Function And Realization Of Local Government In The Implementation Of Enterprise Labor Contract System

30years of reform and opening up, with the reform of the economic system,Chinas labor relations has changed dramatically, interest subjects gradually diversify.As the system of labor contract is closely linked with every one of the interests ofworkers of enterprises in the implementation process appears a few new cases andproblems, both employers and employees as a social structure different interestgroups, there are certain friction and contradiction between them is inevitablephenomenon, the government as a special subject of labor relations, can not shirkthe responsibility in the coordination of labor relations, labor dispute processing andother aspects. So, I learn from the theory of government social managementfunctions starting local government on how best to play an effective role in theimplementation of the labor contract system in the enterprise carry out someanalysis and research, talk about some superficial ideas and understanding.This paper argues that our local government plays a very active role in theimplementation of the labor contract system in the enterprise, mainly as follows:formulate a series of labor contracts system related regulations and policies, promotethe construction of the labor and social security system, standardize the enterpriseemployment system, promote the establishment of a coordination mechanism forlabor relations. It is acknowledged that the implementation of the labor contractsystem of our enterprise exist shortages such as non-standard employment contractstipulated, low wages and the payment of unreasonable, poor working conditions ofworkers, companies do not pay underpaid employees social insurance. The reasonwhy these problems occur, play has not been apparent is closely related to the role oflocal government to implement the labor contract system in the enterprise.Role playsby the local government in the poormainly because of the following three aspects:the implementation of the labor contract system has been the lack of legal protection,there is a certain government function bias, lack of strong coordination mechanism.Bases on this, in order to actively promote the effective implementation of corporatelabor contract system, local government should proceed from own national conditions and learning useful experience of the United States and Japan, to take thefollowing measures: Establish fair and equitable society governing philosophy, andfurther improve the legal system of labor relations, strengthen enforcement of laborinspection policies,strengthen guidance and services to enterprises, building aneffective coordination mechanism of labor disputes.
