In recent years, defective products has caused a lot of mass tortscases in our country, e.g. toxic milk powder, illegal cooking oil, leanmeat powder, bogus drugs and so on. These defective products penetrateinto every corner of society, especially food mass torts. It causescustomers to become victims and need legal remedy to help.Food is the most important essential in human’s livelihood, peoplecan not live without food, that’s why people pay so much attention onfood safety. Whereas, it appears so many food mass torts all over the worldrecently, which occur personal injury, property damage, metal impairmentand other interests on massive victims even new-born baby. This articlewill take food mass tort as breakthrough point, analyze the feature,constitution, legal remedy of our mass tort issues. Meanwhile, draw thelessons of legal remedy from abroad to find out a more suitable measureto improve our legal remedy and solve the mass tort in our country in orderto safeguard people’s rights and interests.This article put forward the preliminary concept of our legal remedyof food mass tort on the basis of analyzing the legal system of westerndeveloped countries. The preface introduces the current status of our foodsafety, typical case and research background, put forward the purpose andmeaning of the research at the beginning. It defines the relative conceptof food mass tort field and analyze its theoretical principle in chapterone. It analyzes the legal remedy of our food mass tort and points outits insufficiency in chapter two. It introduces the legal remedy andtypical cases of foreign developed countries and compare with ours in chapter three. The Chapter four put forward the suggestions on our legalremedy of food mass tort.
