Urbanization is an important symbol of modern human society. It is not only the importantchanges in the structure of human society but also the developing trend of modern civilizedsociety. Since the reform and opening up, along with the sustained and rapid development of thenational economy, China has entered an era of rapid development of urban areas. There arevarying degrees of old city reconstruction and urban expansion across the country. In this process,the number of house expropriations is growing rapidly. Urban house expropriation has played acertain role in promoting the achievement of urban planning goals, reasonable usage of thelimited urban land resources, as well as the improvement of the living conditions of urbanresidents. Urban house expropriation not only plays a role in the prosperity and development oflocal economy, politics, culture, and social harmony and stability, but also affects the houseowner’s personal rights. In the real world of urban development, there are many competinginterests; urban house expropriation broke the original balance of interests, resulting in interestconflicts, as well as social conflicts. These conflicts seriously affected the public perception ofthe government, resulting in social stability problems. In addition, due to our traditionaleconomy and management system, governments at all levels also have some functional problemsin house expropriation. Hence, how the government should play its functions, balance theinterests of all parties, avoid conflicts, maintain social stability, and promote urban developmentbecome the focus of public concern. On January29,2011, the State Council promulgated thePeople’s Republic of China State Council Order No.590,“Regulations on the Expropriation ofHouses on State-owned Land and Compensation Therefor”. This regulation states that any entityor individual house only can be expropriated if it is the needs of public interests. The regulationalso emphasized that the fair compensation should be made to owners of the houses to beexpropriated.Besides, since the government turns to be responsible for the house expropriation,the legal relationship between the corresponding changes have taken place. The introduction ofthis new regulation has already had a certain effect on the house expropriation across the countryand changes have occurred. Therefore, confronting with these changes, how the localgovernments change their functionality, avoid conflicts, maintain social stability and promotesocial harmony and economic development has become the key research problem of this study.In this thesis, I take Jinan as an example to conduct a systematic study about the past andpresent situation of the fulfillment of government’s function during the entire process ofcollecting and compensating for urban property. Starting from the problems existing in thefulfillment of the government’s function, the thesis aims to inquire into such functions of the government as macro-control,marketing regulation, and society management, maintaining thatthe government must clearly define its role in the process of collecting urban property andexercise its function based on current social, political and economic situation, aiming to servepublic’s benefit and advance social progress. Therefore to establish a service-orientedgovernment to accomplish the transformation of government’s function and fully exert its roleduring the process of collecting urban property.
