Analysis Of Definition Of Property Right Of State-owned Enterprise In China

This thesis reviews and analyzes the definition of property rights in the reforming of China's state-owned enterprise and the reforming of the state property management system. It also reveals and discusses the emerging issues of definition of property rights in today's state-owned enterprise. In this thesis, we first introduce basic theories regarding the property rights. The introduction is focused on property rights' definition, its functionality, and its impact to daily life. We also confirm the importance of applying the definition of property rights into the systematic reforming of state-owned enterprise by analyzing the reforming process of state-owned enterprise. We believe that the definition of property rights can avoid the unnecessary cost associate with property rights dispute, and thus reduce the risk of losing opportunities when distributing resources. We then give the definition the unclear definition of property rights and reveal its effects. In doing so, we have shown that it is the main obstacle to build a modern enterprise system in China. At the end, we present a concrete analysis about today's operation of state-owned enterprise' property rights division and thereby draw the following conclusions: 1) during the process of state-owned enterprise definition of property rights, it is essential to distinguish the property rights of state-owned property, the rights of juridical persons, and the rights of private parties, 2) the role that the government plays within the definition of property rights process should be emphasized and should follow appropriate legal procedures, 3) in addition to the efficiency, the fairness should be fully considered when coordinating the state, the employers, and the employees during the process of definition of property rights.
