Land Resources Protection Law Research In The Urbanization Process In China

Urbanization includes agricultural economy, rural industrialization and the inevitable trend of social modernization. Urbanization can lead to the social and economic aspect’s intense changes, and start a more fundamental reform of urban and rural area land use, which raise questions about the protection and utilization of land resources. On the one hand, urbanization is a process that the agricultural labor to non-agricultural labor force and the process of the rural population to urban population; on the other hand, it acts as agricultural land into non-agricultural land and, which causes the increase of urban population and the expansion of urban land use. As the foundation of urbanization, land plays a very important role in the process of urbanization——a large population, the change of industrial structure adjustment of land use and infrastructure construction must be done by land reallocation. With the growth of China’s urbanization, the conflict between land protection and land demand gradually becomes more invisible. In order to solve the contradiction between them, this article takes the land ethics theory as theoretical basis, and comes up with the solution to the urban land resource conflict between development and protection. Therefore, the effective use of land resources in the process of the urbanization, greatly develop the land resource protection practical significance of China’s urbanization. From the use of land resources, we begin research the urbanization process of the land resources protection law, and analyze the existing problems in use and protection of land resources during the process of urbanization, and puts forward the corresponding measures.Besides introduction and conclusion in this paper, the main text is divided into five parts. The first part is mainly the overview of urbanization, including the definition, basic characteristics, and the significance of urbanization. The second part mainly introduces the present legal norms on the theme of land in the process of urbanization in china, including laws, administrative regulations or local regulations. The third part mainly analyzes the problem of the legal system of land resources in our country. This part focuses on China’s land resources problems in practice, and find out the reasons, and then put them into analysis. The fourth part mainly draw lessons from foreign laws of land resources problems. In the last part, on the basis of foreign experience, we try to summarize the methods that can adapt to the legal aspects and land resources protection during China’s urbanization process.
