Study On The Criminal Protection Of Water Resources Of China From The View Of New Environment Protection Law

As we all know,water is the source of life.Now in our country,we are facing a serious situation about water resources.On the one hand,we are in a shortage of water resources,on the other hand,water pollution problems are so serious.Those two problems have become the bottleneck of our country’s economic development,so we should take actions now and work hard to protect our water resources.The new environment protection law revised in 2014 strengthens the protection of environment and resources,and particularly rules to strengthen the protection of water resources.And with the growth of the population and the development of the economy,and the growing attention paid to ecological environment, it is important to protect water resources,especially by criminal measures. But there isn’t any specific regulation about the protection of water resources in our criminal law, as a result,water resources are short of forceful protection. So this paper try to study the criminal legislation about water resources to protect our water resources.The main research methods in this paper are literature research method and comparative approach.By using these methods,this paper think over criminal law protection in our country from the view of new environment protection law.With the guidance of the principles of priority protection and prevention first of the new environment protection law, the author find that we still have some shortcomings.In respect of the legislation contents,there isn’t independent provision about water pollution and potential damage offense in our criminal law.What’s more,our criminal protection of water resources isn’t enough,we also should set provisions about water quantity.And the new environment protection law sets some harsh punishments such as daily penalty,while the criminal penalties which are supposed to be harsher now are light,and the provisions about fine are not perfect,the unlimited fine still need to be perfected.In this situation,the paper propose some proposals about protection of water resources in legislation contents and criminal penalties by drawing lessons from the legislation of some developed countries in environment criminal law,for example,particularly set provisions about water pollution and potential damage offense in our criminal law;set crimes provisions about water quantity;strengthen the criminalpenalties about water crimes and perfect the fine penalty,use numbered fine to punish the water crimes.Then the author hope can propose some useful proposals to perfect our current criminal law in China.
