Study On The Legal And Policy Issues Of China's Low-carbon Economy Development

Low-carbon economy is a kind of clean energy development and efficient use as the basis, low power, low emissions as the basic economic characteristics, follow the concept of sustainable development and control of greenhouse gas emissions required by the socio-economic development model.With climate warming, countries around the world have started in the past to reflect the economic development model. Ecological problems, environmental issues, the harmonious development of man and society issues has received increasing attention, the development of low-carbon economy has become a common choice of all mankind. As the largest developing country, is the largest global carbon emissions, one of the countries. Clearly, there is no active participation of China, the climate problem can not be well resolved. Global low carbon economy growing concern to China to provide a competitive edge to win the international reputation and environmental benefits of the opportunity. Low carbon economy for the benefit of future generations, in line with China to achieve sustainable development, harmonious society.This paper summarized the development of low-carbon economy, foreign legal and policy research foundation, the focus of the development of low-carbon economy, China's laws and policies, and proposed the development of low-carbon economy, China's legal and policy recommendations. Text is divided into five parts: The first part described global warming has become a major issue facing humanity in the 21st century, the development of low-carbon economy has become the choice of the international community; the second part discusses the development of low-carbon economy necessity; third part of the analysis of the United States, Britain, Japan, Italy and other countries in the development of low-carbon economy, law and policy, comprehensive analysis of the international community to develop low-carbon economy, policies and legal instruments, exploring the development of a low carbon economy in China way; the fourth section sets out our current low-carbon economy-related laws and policies, analysis of the reasonableness and the existence of defects; the fifth is on the basis of the above proposed the development of a low carbon economy in China's legal advice. Namely: improving, "Environmental Protection Law" and other relevant laws and regulations; to expeditiously enact the law on climate change; carbon tax; and the "Renewable Energy Law" of the obligations set by the relevant laws and policies with the convergence and so on.
