Oil resources are nonrenewable. As strategic resources, oil resources are the world for "black gold". If you control oil resources, the world is yours. Oil resources guarantee national economic development and social stability. Since the reform and opening up policy comes into force, our economy is developing at breakneck speed and the GNP increases steadily. But the consumption of oil has increased for years. Because domestic oil resources are lack and economic development needs more oil resources, China must import large quantities of oil resources from abroad every year. At present late of oil dependant on the external is more than 50%. It is estimated that by 2020 the late will break through 60%. Limitation of the sources of oil import, geopolitical, war and incident affect international oil market price. Great fluctuating oil prices affect our economy. Facing with bad international oil situation, how to ensure oil security situation is the key of Chinese rapid economic growth. In 1973, the first oil crisis had bad effect on economy in the United States and Japan. Japan actively explored ways to ensure the safety of oil and established its own oil reserve system after the first oil crisis. In 1978, there was no bad influence on Japanese economy in the second world oil crisis, but American economy was plagued by severe blow. Developed countries rely on a steady supply of oil resources for economic development and these countries are actively exploring ways to ensure the safety of oil resources. Oil reserves have been established by laws. Oil reserves could prevent interruption or shortage of oil supplies to avoid economic shock. Oil reserves can guarantee national security and social stability. We started construction of oil reserves some years ago. We have completed the first phase of the project of our oil reserves, and we are constructing the second phase and planning the third phase. That is said, our oil reserves bases are constructed in full swing. But we just begin to study law on oil reserves. Oil reserves can guarantee country's rapid economic development and social stability. At present it is lack of laws on oil reserves. So we should enact oil reserve laws and regulations as soon as possible. Laws can make oil reserves work well and meet national energy security policy.There are four parts to study the legal system of oil reserves in the paper. The first part is overview about the legal system of oil reserves. The oil reserves can prevent national economy from oil crisis and protect national security and social stability. The construction of oil reserves needs a long period and huge sums of money. So we should standardize the oil reserves. Laws and regulations ensure oil reserves work well. Then I raise the concept about legal system of oil reserves. We must establish and improve the legal system of oil reserves as soon as possible. In the second and third parts, I point out some problems about the legal system of oil reserves. Through lessons of the United States, Germany and Japan, combining with the actual situation, we should take some measures to improve the legal system of oil reserves. Firstly, we should offer it the orbit of laws and formulate different levels of legal documents as soon as possible. Secondly, there are some problems about management system and mechanism of oil reserves. We should take some measures to solve these problems. The oil reserves are relation to national security. We should formulate strict oil procurement and use rules. Then, China is the second largest consumption of oil. According to our oil consumption and government financial ability, we should determine reasonable size of oil reserves. At present the way of oil tank to the ground is cost and easy to military attack. Our country should learn from foreign experience and take a variety of ways. Finally, the government provides huge sums of money for oil reserves. This way brings the government's financial burden. We should learn from foreign experience and take several ways to expand sources of fund. The fourth part is about the thinking of legislative work. Making laws is a trend of oil reserves.
