Exploration Into Government-oriented Land Expropriation Compensation Mechanism

Since the founding,by implementing land expropriation system in China, our national construction of the land demand got a powerful guarantee,industrialization and urbanization continued to push forward, all the economic and social development progress is remarkable achievement of career.However,as the huge growth of the country's financial and social wealth and the progressive establishment of market economic system, the land expropriation which was established and developed in the planned economy compensation mechanism appeared more and more drawbacks and it has become more and more difficult to satisfy the demands of the new changing situation.The reform and innovation of land expropriation compensation mechanism has become a significant theory and the time problem in China's economic and social development.In the activity of land expropriation, the current land expropriation compensation mechanism encountered many institutional obstacles.There are more and more such complaint case.Because of land compensation,violence cases occur occasionally ,which seriously affected our country's rural social stability.Meanwhile, the land used for construction has long relied on collecting low-cost collective land. It Led to the abuse of expropriation rights and the farmland has been sharp cut off.These situations threat directly China's food security and social justice.Land expropriation compensation problem has become the focus which can influence both people's livelihood and sustainable development.It has been concentrated on by governments at all levels and the social from all walks of life.This paper attempts to use the institution variance theory to analyze and study the realistic predicament of the land expropriation compensation system in our country by detailed literature and case research,which indicates that governmental dominantive changes are the root cause of the compensation to land expropriation problem. The compensation for land expropriation and its joint-action mechanism that formed during the planned economy era is seriously lagging behind the requirement of socio-economic development. As the endogenetic and core substance of the land expropriation system, the change of land collection compensation system must exert a far-reaching influence on it. Land expropriation system is also a deeply implicated public policy. In this paper, the author introduces the diagnostic tool of the Economics of property rights and the New institutional economics, and combines abundant standardization research with the empirical study. On the basis of pectination to the compensation for land expropriation and its joint-action mechanism, the author first further analysis the trilateral game among local government, landless rural collective and landless farmer during the expropriation of land and market appreciation distribution pattern in land condemnation, the author also proves the nonidentity negotiation strength and the unfair division of earning during the the expropriation of land. Secondly, the author also investigate the issues of public interest and the trilateral benefit game in existing land expropriation compensation mechanism. This paper also expounds the behavior characters of different land expropriation compensation and the current land expropriation compensation mechanism constraint mechanism Mechanism happen system. It mainly discussed the dislocation of the local government and rectification. And finally it puts forward some effective strategies solving our country's land expropriation compensation problem. At last,this paper gives a set of reform plan,which is after the first difficult, gradual easily.
