Study On Multilateral Trade Policy Review Mechanism

Trade Policy Review Mechanism took its shape during the "Mid-term Review" by ministerial meeting in Montreal, Canada in 1989. Alongside the entry-into-force of final act, the legal text of TPRM was simultaneously developed into annex 3 of WTO agreement which serves as one of the three major mechanisms of WTO. It provides that all WTO members should be subject to collective and periodical appreciation and evaluation with the aim of contributing to improve adherence to rules, disciplines and commitments by achieving greater transparency. Being non-confrontational and non-legalistic, TPRM is greatly distinguished in nature form dispute settlement mechanism with an intensified jurisdiction, and those two mechanisms have together constituted the supervisory system for WTO organically.This paper is on the basis of concluding the achievements of TPRM, and trying to analyze it from both theory and practice. From this point, the paper is composed of 4 parts:Part 1 analyze the TPRM from theory aspect. First introduce the history and the main content. From the regulation of GATT to exploration of Tokyo round, and to promotion of seven people report, then to the establishment of Uruguay round, the formation of TPRM is a special process. The content is introduced according to the order of the agreement. Then generalize four characters of TPRM.Part 2 use three examples to analyze that how the TPRM to play in developed country, in developing country and in the less developed country. The three members are Euro union, Thailand and Djibouti.Part 3 introduce the practice that china in face with the trade policy review. First introduce the transition review then the all-around review, and then raise some specific suggestions in the light of the countermeasures towards the challenge that china's trade policy faced with.Part 4 makes some evaluation of TPRM, first analyze on the whole, then point out its deficiency and give advice of consummated measures.
