Research On The Reason Analysis And Its Counter-measure Of The EC Rules Dilemma In WTO

Since the introduction of internet and communication technology into business activities, electronic commerce (EC) has had great impact on the international trade. The rapid developments of EC not only influence the configuration of the international trade, but also challenge to the rules of it, that has become to a problem can't be neglected both in theory and practice. In addition, there is not any rule framework especially for the standardization of the international EC development. And the redaction of the international EC rules has become to an important agenda of World Trade Organization (WTO), which is also the new proposition what the members focus on now.So holding the moment of it, through the systematically analysis of the influences EC has brought to the WTO rules and the exertion of the co-relational economic theories, the thesis analyses the reasons of the rules' dilemma, and then put forward the suggestion to set up EC framework, in order to be in favor of the rapid development of the global EC.The whole thesis consists of four parts mainly:Part one is the introduction of the global EC, including the definition of EC, the development situation of the global EC, and the impacts on the international configuration brought by the developments of EC.Part two is the retrospection of the discussions on the EC rules in WTO, and systematically analysis of the problems EC has brought to the WTO rules, mainly including GATT, GATS, TRIPS and its impacts on the developing countries which is discussed by the Trade and Development Committee individually.Part three is the core of the thesis. This chapter is through the exertion of the co-relational economic theories, analyzing the main reasons of the rules' dilemma brought by EC, including the intellectual property, tariff and the developing countries' problem and so on.Part four is according to the analysis above, giving the solutions or suggestions from the economy ankle for the main problems. And then put forward the suggestions to set up EC framework, in which the author discusses the alternative means and gives the proposals about the basic principles and the primary contents of the EC framework.
