Carrying on the property system reform to the State-owned enterprise is the objective request of the socialist market economy development, as well as the status replacement of the original State-owned business staff, which the staff turns from"the national person","the enterprise person"to"the social person","the market person". After the restructuring, the extra staff's medical insurance expense has no longer undertaken by the enterprise, through social security, business insurance and so on. Medical safeguard questions relate these extra staff's survival and employment, as well as their condition in the improvement and the possibility in returning to the mainstream society. Therefore, it is positively very essential to research the condition of the present situation and analysis the reasons between the contradictory. It is also very necessary to explore the construct reasonable medical insurance insured policy system. The two points above are helpful in manifesting the social justice, eliminating the latent social stabilizing factor, speeding up to realize the socialism harmonious society.This article researches in the investigative of Shenyang. The research based on the interview of the extra staff in the restructuring state-owned enterprise and the investigation of the medical insurance management organization and the supplier to the medical service (hospital). Due to the age and the health condition, the medical insurance demand of the restructuring state-owned enterprise extra staff is urgent. However, because the defects in the system design, the supplies are limited in present medical insurance policy. The present situation is contradictory. And take the present medical insured policy implementation in Shenyang as the example, multianalysis the contradictory existence reason on the two aspects. One is the designed flaw inside the system, the payment cardinal number and rate are excessively high, and the effective incentive mechanism is deficient, which are mainly. The other one is the operational practice outside the system. It doesn't operate standard in the reform process, and the medical expense grows excessively high, which are mainly. Accordingly them put forward the reasonable proposal to build up insured policy system.This article is divided into four chapters. The first chapter is the literature summary. Firstly it introduces the present research situation, the present reform and appraisal of our medical care insurance system. Then it researches about State-owned Remanufacture Enterprise, including the economy compensation to staff status replacement, the laws, regulations and policy-type stipulation of staff rights and interests protection in restructuring of enterprise. The second chapter analysis the contradictory of medical insurance demand and supplies which for the extra staff in the restructuring state-owned enterprise. This chapter mainly uses the method of the interview investigation, First it interviews the state-owned remanufacture enterprise extra staff individually, which takes the age as the variable and divides into three age sections to carry on the interview separately to obtain that their medical insurance demand is urgent. Then it raises the policy implementation in the medical insurance management structure and the medical service supplier (hospital) as an example, which in order to explain that the present policies safeguard level is insufficient and the medical insurance supplies are limited. The third chapter is this article's core. It mainly carries on the reasonable analysis about the contradiction above. This chapter analyses from two angles, inside and outside the system. In the first place, it is the flaw in system designs. The insured threshold is excessively high, the insured condition is strictly limited. Both of them causes many are repelled by the present system who are urgently need medical insurance. The payment cardinal number and rate are excessively high and the fine for delayed payment, which causes the extra staff incapable to pay expenses and insured. The system designs also get unhooked from the payment age to enjoying the treatment level. It lacks the effective insured incentive mechanism, the preferential policy, the subsidy policy and so on. In the second place, it is the reason outside the system. It doesn't operate standard in the State-owned business restricting process. The restructuring enterprise staff are different in status. The medical expense grows excessively high, so the medical insurance demand is urgent. The way for them to have other medical safeguard is limited and so on. In the last place, analysis the related insured policy and gives some appraisals. The fourth chapter gives some suggestions. Through the analysis above, we must be clear about the necessity of constructing insured policy system for the extra staff in the state-owned restructuring enterprise. It is helpful in manifesting the social justice and promoting harmonious society. In concrete system design, on the one hand we must establish a perfect insured system, the payment cardinal number and rate hypothesis, drive and restraint mechanism aspects and so on. Simultaneously we must strengthen the propaganda of the public opinion, form the good social atmosphere in insurers. We should strengthen to construct the reasonable insured policy system positively.
