On The Exception Clauses Of WTO And Their Economic & Institutional Background

WTO is a gigantic system of numerous rules and regulations, within the system there are also numerous and much complicated exception clauses that refer to nearly every field in WTO. The purpose of China's entering actively into WTO is to merge itself with the world economy, and achieve faster and better development and revitalization of its national economy, this is also the request of the reform-and-opening up, and the formation of socialistic market economy of China. As a member of WTO, China has to carry out its promise on the one hand to abide by the free trade principles and rules, on the other hand however, China, in accordance with its actual situation of socio-economic development and its sustainable development strategy, should make full use of the exception clauses of WTO, in order to promote and ensure the steady development of its economy.Theoretically speaking, the study of the exception clauses of WTO will help us make better understanding, mastering, and thereby utilizing of other clauses of WTO. In practice, many of the trade disputes occurred in either stages of GATT and WTO were related to the application of WTO exception clauses. Thus, the further study of WTO exception clauses will be much more helpful in telling us how to cope with trade disputes, and how to protect the domestic industries more effectively and to develop the domestic economy in an optimal way. It is an important topic for China that as a member of WTO how China will find out a balance in its foreign trade polices within WTO system.Till now, there are a few scholars in domestic and abroad have studied the exception clauses of WTO specifically, and almost all of them took up their researches from the legal angle of view. Differentiating from that, this thesis tries to make a preliminary study on the exception clauses of WTO from another visual angle of economic aspects.First of all, this thesis makes a general introduction to the exception clauses of WTO, which consists of the concepts and characteristics of the exception clauses; and the summary of previous researches on the exception clauses at home and abroad. Then on this basis, the thesis makes a comprehensive classification of the exception clauses in accordance with their impact in different areas of WTO, and bases the research of greater depth upon the economic reasons, institutional background of international law, as well as the intrinsic relations and restricted conditions of the exception clauses. Finally, various impacts of the exception clauses on the international economic are studied.
