Study On The Creditor's Governance Right In The Financial Governance Of Stakeholders

Since the 20th century since the 1960s,Stakeholder Theory have gradually begun to take formation and development.In the early 1990's,Stakeholder Theory presented a challenge to the"Shareholders First"Theory.Domestic scholars applied the concept of Stakeholder to the company's financial field.This paper topic is to study the governance right of creditors according to the Stakeholder Theory,in order to further improve the system and the corresponding mechanism,to protect the legitimate rights and interests of creditors from being encroached upon,thereby enhancing their participation in the financial governance initially.This paper combinations Stakeholder Theory and financial governance organically,on the basis of overview and analysis of Stakeholder Theory and Stakeholder Financial Governance Theory.Only that the interests of stakeholders achieve to the largest,the value of the business can fundamentally be improved and the financial governance will be more effective.This paper thinks that there are a series of problems in the current situation of China's enterprise financial governance due to the lack of creditor governance right.There is important theoretical and practical significance to strengthen the financial governance right of creditors.In the finally,in according to the status of governance of our country's financial governance,as well as the reasons for the lack of the governance right of creditors,the paper will improve the corresponding incentive and restraint mechanisms to ensure that creditors can be participated financial governance efficiently and legally,at the same time,we should vigorously improve China's securities market and our bankruptcy system,as an external protection system.If the creditor are given the company the right of financial governance certainly,Companies operating with the debt can prevent from the vicious circle.On the other hand,harmonious and healthy development of Company Activities can also be guaranteed.At the same time,this is an inevitable requirement to establish the Harmonious society in China.
