Study On Intellectual Property Rights Pledge Appraisal

Along with the development of economic globalization and the emergence of the knowledge-based economy, intellectual property rights has become strategic resources for a country to enhance its national power and improve the international status. The High-tech small and middle enterprises of China, which is accomplished in technology exploitation, technology transfer, technology consultation, technology service and make the research, exploitation, production and management of the technology products as its main business, is the most innovative vitality and development potential group in the enterprises, and it is the most important subject that implements the IPRs strategies and enhance the ability of independent innovation. However, Financing difficulties block the High-tech SMEs rapid development, because they may be faced with many limits of their own small scale, less available assets for pledge, as well as bank loan approval system. The financing mode of IPRs pledge loan provides a new way for the High-tech SMEs financing. But the key of the financing mode that can implement the IPR pledge financing favorably is, for the assets evaluation organization, how to evaluate the value of IPR reasonably in order to provide the determining basis of the loan, reduce the risk of loans for the banks and other financial institutions and, at the same time, help the High-tech SMEs financing better.Based on the present situation of the IPRs pledge appraisal , it is found that both at home and abroad the study on the appraisal for relevant guarantees for bank loans is more about the mortgaged assets appraisal. But the study aimed at evaluating the assessment problems of intangible assets especially IPRs pledge for loans is at the initial stage. This paper set forth the intellectual property value's formation and sources, expound the meaning of the IPRs pledge and its elements. Comparing with chattel mortgage assessment, mortgaged assets appraisal, and the evaluation of IPRs for different purposes, this paper summarize the characteristics of IPR pledge appraisal. This paper probe into IPRs pledge appraisal detailed from the way of theory and method. In the appraisal theories research, analyze the value type and the assumption of appraisal. In the appraisal method research, based on the analysis the applicability of the three basic methods, this paper raises a way called the Pledge Coefficient to quantify how much effect various factors make to the value of IPRs pledge in the course of IPRs pledge.
