The legislature exercises legislative power to the constitution and the government exercising administrative power judging by laws and statutes.Because of the particularity of the tobacco industry and the harmfulness of the tobacco products, our state has brought the tobacco industry into the administrative system, set up the tobacco company the tobacco selling-only administrative authorities, reinforced controlling at each link of buying, processing, transporting and selling. Our state still reinforces the criminal of breaking the law about the tobacco.Nowadays, the executive system has built in tobacco industry. The selling-only authority of the tobacco has got gigantic achievement. But the executive system and the executive actions still have many problems. It has significant effect on the construction of the harmonious society to reinforce tobacco ranks of law-enforcing personnel, standard the actions of law-enforcing and improve the law-enforcing ability.Firstly,this dissertation introduces a lot of basic concepts which are related to the law-enforcing of the tobacco administration and analysis the special vocabulary basing on the administration.Secondly, the dissertation introduces the history of our country's tobacco monopoly system.Then,it introduces three kinds of popular tobacco industry manages system in foreign counties and shows the management of other countries on the tobacco industry and the addition of our country .Thirdly, the dissertation carries out four typical cases according to the analysis and contrasts. It tries to hand up the problems among them, and then gives up some resolving methods.
