Legal Measures On Risk Control Of Microcredit

Microcredit which turns to the low-income strata and provides financial services to small enterprises, is operated mainly by major commercial banks, policy banks and a large number of non-governmental organizations in our country. Micro credit plays an important role in financial innovation and building a harmonious society, and the Chinese Government has paid much attention to and vigorously developed microfinance industry in recent years. However, as micro credit has its own distinct characteristics in the organizational structure and operational mode, so it is different from the risk characteristics of ordinary commercial banks. How to use legal means to control the risk of micro credit has become a problem worthy of study. Therefore, according to the actual situation of it and after learning from the successful experience of foreign countries, it is necessary to formulate a unified legal system of micro credit. The system includes:to clear the legal status of China's microfinance institutions; to perfect the regulatory legal system of micro credit; to provide a wide range of market access to legal system; to better market-oriented interest rate laws and regulations; to sound micro credit evaluation system of our country.Concerning about questions such as the organization law localization, supervision ownership being not bright, and supervision law vacancy, which appear in view of our country jot credit developing process, this paper proposes our country jot credit risk control legal countermeasure, after concluding the legal risks of foreign micro credit control of the practice and theoretical studies and unifying our country's actual economic condition and the physical demand.
