A Study On The Internal Governance Of The Private Trust Funds In China

There are lots of controversies about the situation of the private funds in China including the scale and the policies. The government is also takes it as a big issue. However, it is still viewed as a "black box" in most of the literatures because of it's unique role in laws. Additionally, there is little research on the internal governance of the private trust funds. The norm and improvement of the private trust funds which was published in 2007 are urged to be done.Before doing the paper, we got a lot of data about the private trust funds by using the method of questionnaires, the method of conversation and the method of observation. In this paper, we focus on the characteristics of the private trust funds, and discussed the real legislative positions and the benefit distribution of the main subjects in the market of the private trust funds by using the data. After that, we offered some practical suggestions including the structure of the internal supervision and the implementation of the contracts.
