Study On Legal Problems Of Strategic Petroleum Reserve Of China

In recent years, with the continued development of China's economy, the contradiction between oil supply and demand is growing larger and larger. Couple with the rising oil prices, China's security situation of oil is not optimistic. So China must take certain measures to ensure oil security. Strategic oil reserve system is one of the most effective means that ensure the oil security, the successful experience of developed countries has proved this system would play an important function when the oil crisis happens. We should build the legal system of the strategic oil reserve.This article begins with the concepts of strategic petroleum reserve and basic theories. Through elaborating the role of oil reserve system, the current security situation in the oil and the law's important status in system of the strategic oil reserve, it demonstrates the need for building the system of oil reserve and legislation in advance. So we should put on the agenda of the legislative work of the conclusions. Next, the article describes the development history about the law of strategic oil reserve in the United States, Japan and Germany. This paper analyze the patterns and scale of the reserves, reserve position, funding sources, the use of conditions, management and other important legal issues .With the comparative study we should identify the parts that our country can deserve. The fourth part of the article focuses on China's oil reserve system of the status of research, compared with developed countries and to identify weaknesses and shortcomings. That can be the foundation of legal suggestion.Through the above analysis and research, this article sets out the legal suggestion of China's oil reserve system in the last part. The reserves target should be made clear first of all in Petroleum Reserve Act, which is the core of the whole law. Then the law should be covered by reserve size, reserve mode, location choice, the source of funding, management mechanisms, such as a series of specific measures. Last, the process of building the legal system is long, we should focus on China's national conditions in stand of copying the foreign code.
