The Legal Regulation Of The Monopoly Of China's Electricity Power Industry

Due to the nature of natural monopoly,our country has adopted a mode that the nation monopolizes the industry and the industry is subjected to the administrative management. This paper reflected the defect of the vertical integration management mode baced on the traditional management model,combining the relevant provisions of "anti-monopoly law". The emphases and innovation of this article is:Working out the strategy of breaking up monopolies of each aspect and achieving effective competition,in accordance with the division of all the aspects in the power industry on the basis of the the natural monopoly in economics:The power generation and the sale of electricity are fully competitive aspects of the field;transmission of the power still belongs to the typical aspect of the natural monopolies because of their enormous fixed sank capital and economy scale;the distribution aspect in relation to aspect of transmission,though with a characteristics of sinking fixed capital,however,characteristics of economy scale are only limited at a certain range,it has a relatively weak natural monopoly and can induce competition appropriately.This paper has also put forward some legislative proposals of improving the regulatory system,the administrative examination and the law system of anti-monopoly in power electricity industry.
