Along with the development of the coincident in the telecommunications sector and the changes of the supervise of national policy, China's telecommunication market changed from two wire-operators (China Telecom,CHINA NETCOM) and two wireless-operators(China Mobile,China Unicom) to three all-business-operators (China Mobile,China Telecom,China Unicom)。Foresee, along with the readjustment of telecommunications, market competitions in all-business-operators will cause some change to our economy and society。The title is "Study on Illicit Competition of Telecommunications", according to the current law of illicit competition, and discussion about the possible illicit completion of telecommunications, to bring up some corresponding countermeasures。The thesis including 3 sectors:the 1st sector, based on legislation changes of telecommunications, introduces 6 kinds manifestation of illicit competition about telecommunications recapitulatorily:crooked promotion, misadvisement, swindle, anti-competitive practices, commercial bribery and illicit prize-winning purchase, intruding of commercial secrets, maligning of goodwill。The 2nd sector introduces the influence of the rule of anti-illicitly-competition, introducing 4 kinds of actions, on suspicion of rooked promotion, misadvisement, swindle, anti-competitive practices, commercial bribery and illicit prize-winning purchase, and obviously or hidden legal risk。Including civil responsibility, administrative responsibility and criminal responsibility。The 3 rd sector according to the illicit competitions, combines the practicalities of the telecommunications, offer some corresponding advices to control or provide the legal risk。Such as avoidance of exclusive contract, avoidance of pricy discrimination, avoidance of commercial bribe, and crime of giving a bribe。...
