A Study On Financial Business Patent Based On Core Competitiveness

As a core of modern economy and a knowledge-intensive industry, finance is particularly significantly influenced by information revolution and technological innovation. The information revolution has directly caused financial service computerization, network of money market and automation of financial transaction processing, resulting network finance rapidly developing and presenting"technical finance"tendency. Take the banking industry as example, from traditional deposit and loan business and payment settlement service to the bankcard service, the electronic bill service, the electronic bank, trust management, the asset securitization and the financial derivatives transaction, every service innovation of commercial bank is related with the information technology. It can be said that who has and masters information technology, who will have the possibility to occupy the dominant position in the future intensive commercial competition. Financial business method patent, as the main legal mean protecting financial information technology, has played an important role on the development of information technology in the financial industry and decided the height of core competitiveness of financial enterprise in the future.The paper has divide into forth parts studying financial business method patent. First of all, this paper summarizes core competency theory and business method patent theory, and it defines three concepts: business method, business method patent, financial business method patent. Then the paper obtains that financial business method patent can help financial enterprises to promote core competitiveness through analyzing the relationship of finance innovation, core competitiveness and financial business method patent. The third part uses the newest patented claim data and the patent map tool to analyze present situation and gets results that there are some problems in patent quality, the patent distribution and rationality of patent claiming. Finally, this paper gives some suggestions from two aspects: country and financial enterprises.
