Analysis Of The Pesticide Market Supervision And Law Enforcement Status Quo And Strengthen The Mechanism

This paper introduced the definition of pesticide and emphasized its function, considering the times background of the integrated administrative execution in Chinese agriculture. It detailed that the background and basis of pesticide market supervision/agricultural administrative execution, the development process and mode, and its content and effect. Then, laws and regulations on pesticide market supervision were briefly described, and some clauses on the production, management and usage of pesticide were recapitulatively interpreted. Meanwhile, the existing problems on the market supervision were expatiated in the countrywide scope and analysed in view of the local instances, especially the illegal matters being classified and depicted. Cause analysis of the problems was carried out from the aspects of administrative counterpart, supervisor and execution condition. Moreover, transverse and longitudinal forms of the systematic structure of pesticide supervision were summarized and the important management links were explained, followed with the discussion of administration system and long-term effective mechanism. Besides, according to the author's own work practice, related cases were illustrated and deeply discussed.The development of agricultural administrative execution was generally slow in China. Though anfractuous causes, it was mainly for the reasons that the condition of agricultural law enforcement was immature, governmental function transition could not be quickly done under the new situation and agricultural management system demanded the improvement.Currently, more than 100 pesticide laws and regulations in agriculture were established. However, operation problems are existing in the law practice. In this paper, after the discussion of certain specific law clauses, it was emphasized that parts of laws and regulations needed urgent improvement to accommodate the situation of our country.Facing to the grim position of pesticide market supervision, five exploring suggestions were made to strengthen pesticide control: establish rational structure of pesticide administration; perfect the pesticide regulations; construct the long-term effective mechanism of market supervision; set up a system to share information; develop the system of chain operations for agricultural materials.
