Study On The Reform Of Government Regulation Of The Administrative Monopoly Industry In China

With the development of market economy, the monopoly has brought many questions, in which especially serious is the administrative monopoly. Large number of administrative monopoly has seriously affected China's economic development. Administrative monopoly is the central, local governments and their respective departments abuse their power to prohibit, restrict or impede competition and undermine market economic order. China is in the process of the improvement of socialist market economic system, and the government regulation system also continues to change, improve. The administrative monopoly's particularity, complexity, great danger exacerbate the difficulty of the government regulation. How to regulate administrative monopoly effectively is the theory community and government decision-making departments major problem, while also the community express great dissatisfaction because the danger of the administrative monopoly has not be effectively checked.Based on predecessors'research, theory and practice, combining abstract, comparative analysis research methods have been used. In this paper, the government regulation of the administrative monopoly industry is the object of our study. Through the study of the developed countries'regulation of the administrative monopoly industry, combined with China's specific national conditions, to have an in-depth research of China's government regulation of the administrative monopoly industry.This article is composed of six chapters, of which the third, fourth and fifth chapter are the main part of the thesis:The first chapter is introduction. This section introduces the background and significance of the topic, domestic and foreign research results, this paper's ideas, methods and main content.The second chapter is the basic theoretical. Based on the explanation the concept of the administrative monopoly, the administrative monopoly industry, government regulation, regulatory agencies, to have a comprehensive analysis of the basic theory of the administrative monopoly regulation and deregulation.The third chapter is the analysis of the status of government regulation of the administrative monopoly industry. As the administrative monopoly own it's problems, China's regulatory system is in absence and we need to correct guidance of the administrative monopoly industry, government needs to regulate the administrative monopoly industry. But during the process of regulation, many issues arise:the regulatory agencies lack the necessary independence, the functions of regulatory agencies is not clear, inefficient regulation and other issues. After that, make a corresponding analysis of the cause of the failure of regulation.Chapter IV is the horizontal comparison. Make analysis of the United States, England, Japan's government regulation on the administrative monopoly industry. Administrative monopoly is universal, and also has its own necessity, not only in developing countries but also exist in developed countries, it is different just in form and existence. By summing up these countries successful experience, our country's reform can have useful references.Chapter V are the policy recommendations of the reform of the government regulation of the administrative monopoly industries. Build an independent, authoritative regulatory agencies is the key of the government regulation reform of the administrative monopoly industry. In this paper, I propose to establish a comprehensive, cross-industry, and independence regulatory agency to construct an effective regulation system, supplemented by economic reform, political reform, strengthen the legal construction and other measures to enhance the effect of government regulation of the administrative monopoly industry, but also to better promote the development of administrative monopoly industry.
