On "the Classification Of Complex And Simple" And The Mechanism Of Fast Process

"The historical experiences demonstrated again and again that the perfect one in theoretical aspect would not be the one in practices and the working system would not be the perfect idea in advance". As the great practical legal issue, to focus over the working rules in practices and explore the insider values in"living law"in order to rethink the current system is the logical root of this paper.The paper mainly exams and analyses the procedure of classification of complex and simple cases and the subjects, the targets, the processing programs and the theoretical values of the fast process mechanism, the actual effects of the mechanism and the puzzles and the reasons in the processing as the judicial process in a basic court as the sample. Upon the basis above, the author considers the following five aspects on the classification and the fast process mechanism: one is to put forward the rationality of the setting in the accepted court of the fast mediation organization based on the third practical models and the processing control power and the enhancement of the effective; two is to distinguish the different stages such as the withdraw in the acceptance in simple process, the pre-hearing mediation and the decision of fast processing in order to establish the encouragement of the civil fee system of the fast process mechanism; three is to bring up the agent system of the lawyer based on the characters of this mechanism; four is to ponder over the non-appeal system by the parts'agreement; five is the relative perfecting suggestions.
