Analysis Of The Positive And Normative Of The Shanghai "fishing Law Enforcement"

In the year 2009, the disclosure of the "fishing law enforcement" by Shanghai Minhang District and Pudong New Area traffic administrative law enforcement brigade caused widespread concern. The society discussed this issue from different point of views. In this paper, we use Empirical analysis, start from the situation of "fishing law enforcement", and empirical research the connotation, features and the illegality objectively. By using the analytical method, based on the value judgments, we analysis the reasons, the rationality of temptation investigation deeply, By the comprehensive and deep analysis, we could correctly understand the legal nature and empirical problem, further explore how to strengthen the rule of law enforcement action by the social influence, and to promote our administrative law for the course of practice.
