Discussion On The Behavior Of The Crime Of Organizing The Minor To Carry Out Activities Against The Public Security Management

In recent years, more and more juveniles are organized to implement crimes of violation of public order and security administration, such as theft, fraud, robbery, extortion and other acts. Before the introduction of "Crime Law Amendment 7", we have difficulty to regulate those acts effectively by the law of our country. In view of this, Article 8 of the "Criminal Law Amendment (7)" have put the act of the organization of juveniles violating the law of public order and security administration into acts of crime and clear of such acts a criminal offense, which is called juveniles violation of the organizational activities of public order and security administration. This has undoubtedly played a more active role in the protection of juveniles and the social stability. Meanwhile, the crime of juveniles violating the organizational activities of public order and security administration is not very clearly formulated. There are considerable controversies especially in the formulation of the objective aspect of the crime which brings certain difficulty for the legal staff to put it into practice. The organizational behavior is undoubtedly the core element of the crime. This article is aim to analyze the organizational behavior on its concept, characteristic and the age and number of the organized in depth, and combined with the analysis of relevant judicial practice, Hope to benefit the proper use of this crime.
