From the end of the Twentieth Century, The galloping development of the technology of network and digital communication has achieved a tremendous changes of people's information acquisition and communication mode, great to met the neoteric's desire of accessing to vast amount of information expeditiously. But as the development of all the other technology, in the train of the development of internet communication technology, variety of negative effects have appeared, specially the tort liability of ISP( stands for Internet Service Providers ). In this condition, how to seek the legitimate duty standards of ISP and the interests balance between the copyright owner and the ISP have become the new issues in the study and juridical practice of internet copyright in China."Harbor Principle"and its exclusion clause the"Red Flag Standard System"were firstly established in the Digital Millennium Copyright Act of 1998 of USA, and now have become the General Standards of ISP's tort liability in the worldwide."Regulation on the Protection of the Right to Network Dissemination of Information"has come into force by using"Harbor Principle"and its exclusion clause the"Red Flag Standard System"as a blueprint. Combining with the newly revised"Copyright Law","Regulations for the Protection of Computer Software","Supreme Peoples Court Several Issues concerning the laws Applicable to the Trial of copyright Disputes Involving Computer Networks Interpretation"and other related laws and regulations,"Regulation on the Protection of the Right to Network Dissemination of Information"has made up the insufficiency of former Internet intellectual property protection legislation and will be more comprehensive norms of on-line intellectual property protection. Nevertheless, there are still some weaknesses of Chinese ISP laws need to be adjusted and improved.In this thesis, Comparative analysis and Empirical analysis methods will be used, while science of construction of law as a central theme, and the author will offer some legislative proposals basing on our existing norms and judicial practice, drawing on the foreign advanced legislation and practical experience. The thesis includes five chapters: the first four chapters will focus on introducing and analysing conception, characterization, classification of relative theory; In the last chapter, the author will offer some legislative proposals for revising the copyright system and attaining the interests balance again in the network space.
