| Since minor is an important social subject, their property rights have been protected in many countries by varying degrees under the global trend of"children first". Nowadays, in the codification of Chinese Civil Code, we must not only grasp the theme of minor's property rights protection, but also ensure its operability, rather than empty generalities. In order to protect the property rights of minors, from the fundamental, overall and long-term interests, fulfilling the responsibility and functions of state and government is foremost; at this stage and for a long period of time, family is still the first choice to protect minors'property rights. Besides, society is an auxiliary force to protect property rights of minors, and the property rights protection of minors need the support of various circles of society.In China, the protection of minors'property rights only has few weak-operational principles, which can not meet the increasingly prominent needs of overall protection of minors'property rights, and conflict with our former policies. Accordingly, this paper analyzes the protection of minors'property rights with three chapters, so as to fulfill a comprehensive protection with the strengths of government, society and family.This paper is constructed and divided into three chapters. In the first chapter, a further analysis based on the previous one shown in the first chapter provides advantages and disadvantages of the protection law for minors'properties in China, and meanwhile an appeal for a serious investigation of situations of such law in China is proposed. In the second chapter, an analysis is provided relating to current situations of protection laws for minors'properties in a variety of countries, and results of benefit are shown as well. In the third chapter, based on experienced we have learnt from foreign countries, several suggestions are given for the purpose of approaching a better protection for minors'properties.From this research, the methodology of protection of property rights can be extended to other rights protection to fulfill the overall protection of rights of minors. |
