A Research On Legal Regulation Of Timeshare

Timeshare has experienced 40 years in the United States and other developed countries. Now, it has its history for nearly 20 years in our country, and has formed a certain size of market.However, as lack of legal regulation, there have been many problems in its development process. Infringing upon consumer's rights occurs frequently, which have created a serious negative impact to the development of timeshare.This paper studies the basic theory and existing problems of in our country, combines with foreign law for the timeshare and ultimately makes suggestions from a legal point, so as to promote the health of timeshare.This paper is divided into four parts.The first part is a theoretical overview of timeshare. First it explains the generation, development, and definition of timeshare, which lays the foundation for later elaboration. Then it discusses the types and legal relationship of timeshare.The second part combines the cases to discuss the existing problems of timeshare in our country. First are three typical cases, and then existing problems of timeshare from macro-view and micro-view.The third part focuses on the legal regulation of timeshare in foreign countries, selects the European Union, the United States and Malaysia these three representative countries or regions, and then points out the inspiration of legal regulation of timeshare in our country.Finally, the fourth part combines the existing problems of timeshare in our country with foreign legal regulation, and makes suggestions to the legal regulation of timeshare from the legislation and the design of micro regulation.
