Risk Analysis On Our Iprs Under Globalization Trend

In the era of economic globalization and knowledge economy, intellectual property and enterprise development as the country's soft power has been taken seriously. Intellectual property risks China suffered have been frequently upgraded, enterprise, industry and the country face three major risks from home and abroad: the subjective risk, system risk and risk practices, national economic security is under serious threat. At present, IPRs risk analysis from foreign countries mainly stand of the developed countries, inadequate attention to the interests of developing countries; most of domestic analysis are case studies and qualitative analysis, they are lack of macro-theoretical guidance and practice. Establish a comprehensive scientific operational risk evaluation index system of IPRs to assess the quantitative risk, to prevent the IPRs risk of countries, industries and enterprises is very important.Based on analysis of a number of risks literature, IPRs cases, experts'suggest, this article found that China faced TRIPS injustices and other foreign risks and genetic resources be plundered, weak protection of traditional knowledge, trade marks were registered as the representative of the domestic risks. The cultural, social ideologies, economic development level, weak sense of action, legislative judicial enforcement of intellectual property rights system are main risk reasons. Under the guidance of Outline of National Intellectual Property Strategy, establish intellectual property analysis system with three-level risk indicators and 26 secondary indicators, and through analytic hierarchy process (AHP) and fuzzy comprehensive evaluation these two comprehensive assessment of measurement methods found that China faces medium level risk in intellectual property, and the practice of the concept and system risk is greater than the risk, practice risk is greater than concept and system risk. So we should focus on Institutional Practice in the prevention and cure of state IPRs risk.This article combines Intellectual property risk and national economic security, AHP and fuzzy comprehensive evaluation method combination is also one innovation point, and make up the current academic analysis in the blank measurement. Standing on globalization vision angle and the developing countries position, we think establishing a new and fair, efficient and balanced world IPRs order is the vision and final end-result of the future international rules on IPR, the new intellectual property rules need to pay more attention to the development of interest of developing countries.
