Trust Services Regulatory Legal System Study

Trust system is an exotic financial system .The function and financing superiority of trust system is much favored by people .Our trust industry has been developed quickly during these years. But healthy development of trust industry cannot be away from strict trust supervision. Recently , China has a lot of trust industry supervision law .The content of supervision involves much things. It is far better than before. Comparing to the character of trust supervision system of other country such as British ,America, Japan, our trust supervision system has a lot of shortage. It includes the imperfection of legal system, low usefulness of the content of supervision. According to the status quo and the shortage, it is essential to renew our trust system,to legislate a Trust Industry Law and to consummate existed law in order to consummate the trust legal system. And it is also essential to consummate the content of supervision from the aspect of market admittance and market Existence and Market Management opromote the pace of legal establishment. We shall establish a trust supervision system which is guided by the government and assisted by the trust guild. It can mostly accelerate the development of trust industry ,which makes trust industry to be one of the four financing mainstay.This article employs such research methods as excavating headstream, historical analysis and comparative analysis. This article comprises six parts .The first part introduces trust and trust supervision by research methods of excavating headstream .The second and third discusses internal and foreign trust system by research methods of historical analysis .The third and fourth and fifth parts points the content of trust supervision by research methods of comparative analysis. The sixth part quests for the consummating our trust supervision system by all the three kind of methods.
