Study Of The Classic Recipe Of Traditional Knowledge Protection Methods

This paper is to research and propose the protection mechanism of Classical Traditional Chinese Medicine (TCM) Prescriptions in the methodology, which are under the framework of the Traditional Knowledge of Chinese Medicine (TKCM) research. This research involves determination of the definition and characteristics of Classical TCM Prescriptions, selection of the List of Classical TCM Prescriptions, content of subject, nature and content of right of Classical TCM Prescriptions, benefit sharing and other link in protection mechanism of Classical TCM Prescriptions.To achieve the method of protection mechanism of Classical TCM Prescriptions,this paper adopts many research method, such as literature, investigation, expert arranges method and case analysis method, etc. to verify this research method. The literature method is to research the definition and protection status of TKCM and Classical TCM Prescriptions. The investigation method is to investigate clinical use of Classical TCM Prescriptions, Production enterprises and situation of Pharmacopoeia promulgation. The expert arranges method is to determin weights of the List of Classical TCM Prescriptions. The case analysis method is to analysis the status of authorization patents, which are originated from or depend on Classical TCM Prescriptions. According to different situations, set up different benefit-sharing mechanisms, and propose protection mechanism and its supporting measures of Classical TCM Prescriptions.Classical TCM Prescriptions, as an important part of TKCM, are necessary to be established special protection mechanism of Classical TCM Prescriptions, to promote mining and innovation, inheritance and development of Classical TCM Prescriptions. The method of establishing protection mechanism of Classical TCM Prescriptions is put forward a maneuverability management mechanism. Through this protection mechanism, provide protection reference for the Traditional Knowledge such as acupuncture, the processing and so on, afford new thought and method of protection of TKCM, and enrich the study of protection of TCM.
