Trademarks Significant To Determine The Legal Issues Research,

The distinctiveness of trademark is one of the most important conceptions, which is the soul of the trademark registration and protection. I, having worked in the Trademark Review and Adjudication Board(TRAB),State Administration for Industry and Commerce for almost 10yrs, am realizing the importance of the trademark distinctiveness step by step. And I want to illustrate my understanding and study of the distinctiveness on the basis of the daily work experiences. The thesis mainly concludes five parts except for the prologue of thesis at the beginning and the conclusion at length.Part 1: The common principles of the trademark distinctiveness. It includes the concept of the trademark distinctiveness and its relationship with unique, identity, originality and creativity, the classification of the trademark distinctiveness, absolute distinctiveness, relative distinctiveness, the change of the trademark distinctiveness, etc.Part 2: The obtaining and degeneracy of trademark distinctiveness. Considering specific case to discuss degeneration and bereavement of distinctiveness and analyze the reasons and strategies to indicate the development of trademark distinctiveness.Part 3: The common principles of the judgment of the trademark distinctiveness. It mainly illustrates four principles of the judgment.Part 4: The study of the typical and forward position questions of the distinctiveness judgment.Part 5: Discusses our country trademark law about the trademark distinctiveness and proposes the suggestions on this issue.
