The Impartiality Of The Administrative Penalty

The administration department deals with things about people all the time, its duty is to govern a property order in public administration, do its own function and one of the most effective method is the use of administration punishment. It is just like a sword with two edges, on the one hand, it can protect peoples'advantage, on the other hand, it can violent their advantages if through inappropriately use. So the purpose of it is to achieve social justice, if the administrators violent the law during the process, it of course will hurt people's rights, and if there is nowhere for people to elaborate their disagreement, the result is always hurt on social stable. So we can say all that require a justice in administration, and the justice requires a process justice.My paper consists of 5 parts. The first is the introduction; mostly introduce the research background, the advantages of it, the situation of the research in and abroad, the thought, the method, the content and so on. The second part ale berates the natural situation of administration punishment through the definition, principle, the punishment rights and the punishment object of the term. The third part based on the former one points out the injustice which occurs in the administration process in our own country. The forth part mostly gives reason of the situation, including the consciousness root, the advantage root, and the system one. The last part is the advices:foster democracy and law among people and the administrators instead of the feudalism one which lasts for thousands of years, build a totally new system of administration punishment in which depart the rights and the advantages, give a sure standard of free right in administration punishment to make sure their duty obey the law.
