P2p Resource Sharing Environment Under Copyright Protection

After the U.S. Supreme Court declared in 2005 that Internet file-sharing sites Grokster and StreamCast had illegally aided their customers' efforts to share pirated copies of copyrighted music and video files, copyright disputes of P2P file-sharing are ceaseless with P2P file-sharing technology developing.This paper will review the typical case of piracy of copyright disputes of P2P file-sharing between Guangdong Zhongkai and Guangzhou Shulian. The case contained all disputes and difficulties in P2P, which includes object confirmation of Responsibility Investigation, theory of Piracy Responsibility Holding and disputes of application of P2P file-sharing copyright Law.Begin by the case, it will introduce the concepts, features, applications and laws of P2P in China, analyze theory of P2P Piracy Responsibility. It will stress on proof of contents, applications and exceptions of the Safe Harbor Provision.Considering national situations, solutions are proposed in order to set up a protection system of network piracy in P2P technology.
